Yesterday, Judge Jocelyn Newman, for the Fifth Judicial Circuit, ruled the practice of capital punishment by means of electrocution or firing squad violates the South Carolina State Constitution and its prohibition on cruel, corporal, or unusual punishments.
This ruling invalidates the law passed by the S.C. General Assembly in 2021 since electrocution and firing squad are the only available means of execution in S.C., thereby permanently enjoining the state from executing inmates on death row.
